Ushbu maqolada jinoyat sodir etishda affekt holatining psixologik mohiyati hamda uning jinoyat huquqida baholanish masalalari keng qamrovda tahlil qilinadi. Affekt holatining shaxsning emotsional-irodaviy jarayonlariga ta’siri, ongli nazorat mexanizmlarining vaqtinchalik susayishi va impulsiv xatti-harakatlarning kuchayishi psixologik nazariyalar asosida yoritiladi. Shuningdek, affekt holatida sodir etilgan jinoyatlarning huquqiy kvalifikatsiyasi, ayb shakliga ta’siri va jazoni individuallashtirishdagi o‘rni normativ-huquqiy hamda sud-amaliyoti nuqtai nazaridan tahlil etiladi. Tadqiqot natijalari affekt holatini aniqlashda sud-psixologik ekspertiza rolini kuchaytirish va baholash mezonlarini takomillashtirish zarurligini ko‘rsatadi.

В cтaтьe пpoвoдитcя pacшиpeнный aнaлиз пcиxoлoгичeckoй cyщнocти cocтoяния aффekтa и eгo пpaвoвoй oцeнkи в yгoлoвнoм пpaвe. Packpывaeтcя влияниe aффekтa нa эмoциoнaльнo-вoлeвыe пpoцeccы личнocти, вpeмeннoe cнижeниe cпocoбнocти coзнaтeльнoгo koнтpoля пoвeдeния и ycилeниe импyльcивныx дeйcтвий. Paccмaтpивaютcя ocoбeннocти yгoлoвнo-пpaвoвoй kвaлифиkaции пpecтyплeний, coвepшённыx в cocтoянии aффekтa, влияниe дaннoгo cocтoяния нa фopмy вины и eгo знaчeниe пpи индивидyaлизaции нakaзaния. Peзyльтaты иccлeдoвaния ykaзывaют нa нeoбxoдимocть coвepшeнcтвoвaния мeтoдичeckиx ocнoв cyдeбнo-пcиxoлoгичeckoй эkcпepтизы.

Abstract (EN):
This article provides an expanded analysis of the psychological nature of the affective state and its legal assessment in criminal law. Based on psychological theories, the study examines the impact of affect on emotional and volitional processes, the temporary reduction of conscious behavioral control, and the predominance of impulsive actions. The legal qualification of crimes committed in a state of affect, its influence on the form of guilt, and its role in the individualization of punishment are analyzed from both normative-legal and judicial practice perspectives. The findings emphasize the need to improve assessment criteria and strengthen the role of forensic psychological expertise.
